Provider: Chen Technologies, [registered address], Accra, Ghana ("we", "Chen SMS").
Customer: the business or person who opens a Chen SMS account ("you").
1. What we provide
A web service to send text messages ("texts") to people in Ghana, through licensed network operators and messaging partners. We do not guarantee a text reaches a phone; delivery depends on the operators and the recipient's phone. We report the status the network gives us.
2. Your account
- You must be 18+ and able to enter a contract for your business.
- Keep your login private. You are responsible for everything sent from your account.
- Give us true business details. We may ask for proof of identity or of your right to use a sender name.
3. Money
- You add money to your wallet in Ghana cedis (GHS). Wallet money does not expire.
- Before you send, we show the exact total price. That is the price you pay. Price = people × texts per person × price per text.
- A long message, or one with emojis or special characters, is split into more texts by the networks and each part is charged. We show you this before you send and tell you which characters cause it.
- Undelivered texts are charged. A text handed to the mobile networks is charged even if it cannot be delivered (for example the phone is off or the number is no longer active), because the networks charge for it. We show delivery reports so you can clean your list. We only return money for a text we could not send at all (for example a number or sender name the supplier refuses) and for a scheduled send you cancel before it goes.
- Top-ups are non-refundable once spent. Unspent wallet money is refundable on request, less payment-provider fees, within [30] days of payment.
- Prices may change; a change never affects a send you have already confirmed.
4. Who you may message
You may only message people who are your own customers or contacts, or who have agreed to hear from you. You confirm the contact list belongs to you and that you may lawfully use it. You must stop messaging anyone who asks to stop. See the Acceptable Use Policy, which forms part of these terms.
5. Sender names
A sender name (up to 11 characters) must be your own business name or one you have the right to use. We may refuse, suspend or remove a sender name that misleads people, imitates a bank, mobile-money service, government body or another business, or is rejected by an operator.
6. Your data
We process your contact lists and message content only to deliver your messages, keep records, prevent abuse and meet legal duties. You are the data controller for your contacts; we act on your instructions as processor. See the Privacy Policy. You can export or delete your data on request.
7. Suspension
We may pause sending or close an account immediately if we reasonably believe it breaches these terms, the Acceptable Use Policy or the law, or if an operator or regulator requires it. We will tell you why unless the law prevents us.
8. Limits of liability
We are not liable for delays or failures caused by networks, operators, power or internet outages, or the recipient's phone. Our total liability for any claim is limited to the amount you paid us in the [3] months before the claim. Nothing here limits liability that cannot lawfully be limited.
9. Changes and law
We may update these terms and will tell you by email or in the app; continuing to use the service means you accept them. These terms are governed by the laws of Ghana.
